Terms of Service for Image to Video AI Generation

1. Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of imagetovideo.org and the Image to Video image generation, image editing, and image-to-video services (collectively, the "Service"), operated under the Image to Video service name.

By creating an account, purchasing credits, or otherwise using the Service, you confirm that you are at least 18 years old, have read and agree to these Terms and our separate Privacy Policy, and have authority to accept them for yourself or the organization you represent. If you do not agree, do not use the Service.

2. Service description

2.1 What we provide

The Service is an online digital software service that lets users create or edit images and generate short videos from images and text prompts. Access to paid generation features is made available after payment confirmation.

2.2 AI output

AI output is probabilistic. Results may differ between attempts and may contain artifacts, inaccuracies, unexpected similarities, or content you did not request. We do not guarantee that output will meet a particular creative, technical, legal, or commercial requirement. Review every output before publishing or relying on it.

2.3 Third-party AI models

The standard configuration uses FLUX.1 Schnell by Black Forest Labs, Nano Banana / Gemini by Google, Seedream 4.0 by ByteDance, Wan 2.6 Image-to-Video Flash by Alibaba, and Kling Video 2.6 Pro by Kuaishou. Requests are commonly routed through fal.ai, and video processing may use Replicate when configured. The active model name and identifier are shown in the generator. Models, routing, features, and availability may change.

3. Account registration and security

Provide accurate and complete information, maintain a valid account email, keep credentials confidential, and take responsibility for activity under your account. Do not share, sell, or transfer access in a way that bypasses account or credit controls. If you use the Service for an organization, you confirm that you are authorized to bind it to these Terms.

Notify support@imagetovideo.org promptly if you suspect unauthorized use or a security incident. Never send us your password or complete payment credentials.

4. Prepaid credit packs

The Service currently sells one-time prepaid credit packs rather than automatically renewing subscriptions. Current pack prices, currencies, included credits, model costs, and taxes are shown on the Pricing page or at checkout before payment.

Credits are a limited, non-transferable right to use eligible generation features. They are not money, do not earn interest, cannot be resold, and cannot be redeemed for cash. Credit use varies by model, media type, duration, and settings. Unless a different period is stated at checkout, purchased credits expire 365 days after purchase.

5. Billing and payment authorization

Each credit-pack purchase is a separate one-time transaction. By confirming checkout, you authorize the displayed charge using your selected payment method. The Service does not currently enable automatic renewal or automatic credit top-up.

Payments are handled by the processor selected at checkout, which may include Waffo Pancake, Stripe, PayPal, Creem, Alipay, or WeChat Pay when configured. Taxes, currency-conversion charges, or processor fees may apply. You are responsible for accurate billing information and for recognizing the merchant or billing descriptor shown at checkout and on your receipt.

6. Credit validity and account closure

Credits are consumed when an eligible generation begins processing. A generation may consume credits even if the result does not match your creative preference. Expired or consumed credits cannot be restored except where these Terms or applicable law require otherwise.

You may request account closure through support@imagetovideo.org. Unused credits remain subject to their original expiration date while a closure request is processed. Once an account is closed, access to remaining credits and generation history ends, subject to any refund right in Section 7 and any mandatory legal right.

7. Refund policy for credits

You may request a full refund for a credit pack within 7 days of purchase if none of the credits from that purchase have been used. We also refund verified duplicate charges or billing errors. Statutory cancellation or refund rights that apply in your jurisdiction remain unaffected.

Consumed credits are non-refundable. Dissatisfaction with the style, quality, or suitability of a probabilistic AI output is not by itself grounds for a refund after processing has begun. To request a refund, email support@imagetovideo.org with the subject Refund Request and include your account email, transaction identifier, and reason. We will acknowledge the request within 2 business days; approved refunds are returned to the original payment method, with posting time controlled by the payment provider.

8. Billing disputes

If you believe a charge is incorrect or unauthorized, contact support@imagetovideo.org with the subject Billing Dispute before filing a dispute with your bank, where practicable. Include the account email, transaction identifier, charge date, and amount. We aim to acknowledge billing inquiries within 2 business days and investigate verified errors promptly. This informal process does not waive any legal right or payment-network deadline.

9. AI content and intellectual property

9.1 Your input

You retain the rights you already hold in source images, prompts, and other material you submit ("Input"). You grant us and our service providers a limited, non-exclusive license to host, copy, transmit, modify, and process Input only as reasonably necessary to operate, secure, support, and provide the Service. We do not use Input to train our own AI models without separate notice and a valid legal basis or consent, although third-party providers may process data under their disclosed terms.

You must hold all rights, permissions, consents, and lawful bases needed to process Input, including rights relating to copyright, trademarks, privacy, publicity, biometric information, and recognizable people.

9.2 Generated output

As between you and Image to Video, and to the extent permitted by law, we do not claim ownership of the specific result generated for you ("Output"). This does not transfer third-party rights or guarantee that copyright or another exclusive right exists in AI-generated content. Similar or identical output may be generated for others.

You are responsible for checking Input and Output before personal or commercial use, including third-party rights, factual or product claims, the selected model's terms, and any disclosure required by law or platform policy.

9.3 Our materials

The Service software, interfaces, branding, site design, documentation, and original editorial content remain owned by Image to Video or its licensors. These Terms do not grant rights to our software or trademarks.

10. Acceptable use

You may use the Service only for lawful purposes and in accordance with our separate Acceptable Use Policy. That policy expressly prohibits sexual or NSFW content, violence or graphic gore, hate speech, child sexual abuse material and other child-unsafe content, non-consensual deepfakes or impersonation, and copyright or trademark infringement. It also explains content moderation, reporting, enforcement, and appeals.

Do not bypass safety controls, probe or disrupt the Service, upload malware, automate abusive traffic, scrape restricted data or outputs at scale, reverse engineer protected functionality, resell access without written permission, or use Service data to train a competing model without authorization.

11. Data, privacy, and security

Our separate Privacy Policy explains the information we collect, how prompts, media, account data, payments, and cookies are processed, applicable retention periods, service providers, international transfers, and your privacy rights. Full payment-card credentials are handled by the payment processor and are not stored on our servers.

You acknowledge that AI, storage, authentication, analytics, support, email, infrastructure, and payment providers may process the minimum information needed to perform their functions.

12. Disclaimers and limitation of liability

The Service and Output are provided "as is" and "as available" to the maximum extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation where those disclaimers are permitted. AI output is not legal, medical, financial, or other professional advice; consult a qualified professional before acting on it.

To the maximum extent permitted by law, Image to Video and its providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, data, goodwill, or opportunities. Our aggregate liability arising from the Service will not exceed the amount you paid to the Service during the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits liability or consumer rights that cannot legally be limited.

13. Service availability, suspension, and termination

Generation may be delayed or unavailable because of maintenance, provider capacity, safety checks, network failures, or events beyond our control. We may add, modify, limit, or discontinue models and features, impose reasonable usage limits, and take steps necessary to protect reliability and security. We do not promise permanent storage of generated media; download important files promptly.

We may restrict, suspend, or terminate access if we reasonably believe you violated these Terms or the AUP, created legal or security risk, failed to pay a valid charge, committed fraud, or abused the Service. Where appropriate, we may provide notice and an opportunity to correct the issue. Sections concerning payments, rights, privacy, disclaimers, liability, disputes, and enforcement survive termination where their nature requires it.

14. Governing law and disputes

These Terms are governed by the laws applicable to the operator of the Service, without overriding mandatory consumer protections that apply where you live. Before starting formal proceedings, contact support@imagetovideo.org with the subject Legal Dispute and allow a reasonable opportunity for informal resolution. Nothing here prevents either party from seeking urgent injunctive relief or using a legally available consumer or regulatory process.

15. General provisions and changes

These Terms, the Privacy Policy, the AUP, and any checkout terms form the agreement between you and Image to Video concerning the Service. If one provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization, or transfer of the Service.

We may update these Terms for product, provider, legal, or security changes. The date above identifies the current version. Where required, we will give notice of a material change through the Service or the account email before it takes effect. Continued use after the effective date means acceptance where legally permitted.
